What is a lien waiver?

A legal document where a subcontractor or supplier waives their right to file a lien against your property after being paid. Required by most banks for draw packets.

Which type of lien waiver do I need?

Conditional Partial for progress payments before the check clears. Unconditional Partial after payment clears. Conditional Final for the last payment before it clears. Unconditional Final after final payment clears.

Does my state have specific lien waiver forms?

12 states require statutory forms: Arizona, California, Florida, Georgia, Massachusetts, Michigan, Mississippi, Missouri, Nevada, Texas, Utah, and Wyoming. All other states accept standard forms.

What if a sub refuses to sign a lien waiver?

Do NOT pay a sub who refuses to sign. A signed lien waiver is your protection against double-payment claims. This is non-negotiable and a standard business practice.
